1. Acceptance of Terms
By engaging Pulse Graphix for design services or using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services Provided
Pulse Graphix provides creative design services including but not limited to logo design, brand identity, web design and development, print design, social media design, motion graphics, and presentation design. The specific scope of work for each project is defined in individual proposals and agreements.
3. Proposals and Agreements
Each project begins with a detailed proposal outlining the scope of work, deliverables, timeline, and pricing. Work commences only after the client approves the proposal and any required deposit is received. Changes to the scope after approval may result in adjusted pricing and timelines.
4. Payment Terms
We offer three payment options: (a) 100% upfront with a 5% discount, (b) 50% deposit upon project start with the remaining 50% upon final delivery, or (c) milestone-based payments for larger projects. Invoices are due within 14 days of issuance unless otherwise agreed. Late payments may incur a 1.5% monthly interest charge.
5. Intellectual Property
Upon final payment, full ownership and copyright of all delivered design work transfers to the client. Unused concepts and rejected directions remain the property of Pulse Graphix. We retain the right to showcase completed work in our portfolio, website, and marketing materials unless the client requests otherwise in writing.
6. Revisions
The number of revision rounds is determined by the selected package tier. Starter packages include 2 revision rounds, while Professional and Enterprise packages include unlimited revisions. Revisions refer to modifications within the agreed scope of work. Requests outside the original scope constitute additional work and will be quoted separately.
7. Project Timeline
Estimated timelines are provided in the project proposal. These timelines are contingent on timely client feedback and approvals. Delays in client responses will proportionally extend the project timeline. Rush delivery is available upon request and may incur additional fees.
8. Cancellation and Refunds
Either party may cancel a project with written notice. If the client cancels, payment is due for all work completed up to the cancellation date. Deposits are non-refundable once work has commenced. If Pulse Graphix is unable to complete a project, the client will receive a full refund for any undelivered work.
9. Limitation of Liability
Pulse Graphix shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services or deliverables. Our total liability for any claim shall not exceed the total amount paid by the client for the specific project in question.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of France. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.
